Georgia Probation Revocation?
My husband has completed two years of probation on a ten year sentence in Georgia. Upon deployment to Iraq with the FL Air National Guard his PO filed for the issuance of a warrant for failure to report August 06 and leaving the State of Georgia. The PO had knowledge of his deployment months before his departure. I contatced the Chief Superior Judge and made him aware of the situation, he then instructed the Judge who signed the warrant to vacate the wrrant in which she did. Upon the PO learning that the warrant had been vacated, she contacted the sheriffs office to arrest my husband. He was held until she got a second warrant for the same charge and returned to Georgia on Dec 15th. His first revocation hearing was January 4th. The Judge made the statement, "Either he is going to Iraq or going to prison!" How can a judge base a revocation on my husband's military status? She would not listen to my husband's attorney. It is very clear that she is biased. Any info will be appreciated.
